AMENDED STATE OF EMERGENCY ORDERS FOR CORONAVIRUS

(COVID-19) 30^th April 2020

 GOVT. PRESS SECRETARIAT; The State of Emergency Order has been extended by another four weeks not including new amendments signed into law this evening by the Head of State.

In consultation with Cabinet under FK (20) Special 22, and pursuant to Article 106 of the Constitution, the Head of State issued the following orders (with amendments included).

The amended orders are printed below in it’s entire;y;

1. National fasting and prayer:

A national period of fasting and prayer is to be observed by every family in Samoa from Sunday 22 March 2020 until Sunday 29 March 2020 from 6.00am – 12.00pm daily.

• International travel, planes and ships:
• Except in exceptional circumstances approved by Cabinet, all international travel to and from Samoa by plane are ceased.
• The following are important under this Order:
  • For any passengers intending to travel to Samoa, the following considerations and categories of travelers are relevant:
    • returning residents and students with returning tickets;
    • where travel permits have expired;
    • the need for essential services for Samoa; and
    • any other special and relevant ground for travel to Samoa.
  • The following mandatory terms for each passenger apply:
• a COVID 19 test has been done within three (3) days before departure for Samoa; and
• confirmation of completion of the 14 day quarantine period, before departure for Samoa; and

(iii)     to be quarantined on arrival in Samoa for 14 days.

• All boats and ships are prohibited access except:

(a) for trade and petroleum; and

(b) fishing boats approved for offloading, refueling and the restock of necessary supplies.

(4) For fishing boats under (3)(b) the following apply:

(a) a maximum of 2 boats may dock in a day; and

(b) medical and quarantine requirements are to be complied with;

(c) no crew member is to leave the boat;

(d) boat schedules must be submitted to the Samoa Ports Authority (SPA); Ministry of Agriculture and Fisheries (MAF); Ministry of Police and Prisons Services (MOPPS) and the Ministry of Health (MOH); and

• the date of departure from the last port, or the exchange of any crew members whilst at sea, must not be less than 28 days, before arrival at Apia wharf; and
• notification of arrival date must be received by the relevant authorities (MAF and SPA) 5 days prior; and
• there shall be no exchange of crew members whilst as sea.
• The Ministry of Health is to continue with the approved medical clearance of all involved.

• Public gatherings:
• For Church, the following applies:
  • there shall be one church service on Sabbath day (e.g. on Sunday for EFKS, on Saturday for SDA); and
  • social distancing of 2 meters is to be observed; and
  • there shall be no crowds around church buildings before and after the church service, or for any other after church activities; and
  • the church Minister (faifeau) is to ensure the 2 meter social distancing in the church is adhered to.
• The restricted number of no more than 5 people apply to the following:
• funerals, traditional title bestowals, birthdays, weddings; reunions; and
• opening ceremonies for buildings (umusaga).
• No public gathering for gaming of any kind e.g. bingo and casino is permitted.
• For sports, non-contact sports e.g. golf, tennis, volleyball, and gym operation are permitted. Contact sports are not permitted e.g. rugby.

(5) Swimming at beaches and rivers is permitted, except on Sunday.

(6) All nightclubs, bars, theatres, or any other public place where people are accustomed for social gatherings, are to be closed.

(7) Hotel bars may open at normal hours.

• Restaurants are opened:
  • for dining in and take away from 6.00am to 10.00 pm; and
  • during dining, the restaurant owners are to monitor and enforce the 2 meters social distancing rule.
• All people are prohibited from gathering at airports or wharves unless it is for permitted travel.
• Public transport:

Buses and Vehicles

• For bus transport:
  • buses may continue normal operation; and
  • no bus service is to operate on Sunday.

(2)   Operators of public transport that carry 5 people or less are permitted to continue operation.

Ferries

(3) Ferry services between Upolu and Savaii are on the following terms:

• there shall be no ferry services on Sunday; and
• ferry services are on Monday to Saturday, operating the normal schedules; and
• the shipping authorities are to monitor and enforce the 2 meters social distancing rule during travel.

(4) All persons 60 years and above are strongly advised to adhere with the restrictions under Order 8 (travel restricted to only if seeking medical attention).

• A Pensioner who chooses to travel for any reason outside of those under Order 8 will not be able to use the Pension benefit of free travel.

• Markets, small shops, supermarkets, and businesses:
• For markets:
• the markets at Savalalo, Fugalei, Salelologa, Vaitele, Taufusi and Afega, and all other flea markets, fish market or any market which the public have access to:

(i) are permitted to open from Monday to Saturday, from 6.00am – 6.00pm; and

(ii) no person is to sleep overnight at any marketplace; and

• all markets are closed on Sunday, inclusive of:
• the markets at Savalalo, Fugalei, Salelologa, Vaitele, Taufusi, Afega; and
• the Fish Markets at Savalalo, Vaigaga, Fasitoo Uta, Afega, and any other roadside fish selling; and
• any such market where the public has access to.
• For supermarkets:
• from Monday – Saturday, the opening hours are from 6.00am-6.00pm; and
• for Sunday, the opening hours are from 3.00pm-7.00pm; and
• this rule for supermarkets does not affect small shops which may operate normal hours.
• All businesses must close on Sunday, except:
• small shops which may operate normal hours; and
• the supermarkets in the restricted opening hours as stated above in (2)(b).
• For the purposes of this Order:   
• “supermarket” is a shop where a person walks in through doors to purchase any groceries, and any other item; and
• “small shop” means a small shop with no walk in doors, and where purchase is made through the window opening/s.

• Street vendors:
• There shall be no selling of any goods beside roads, street, culverts or footpaths in the town areas of Apia, Vaitele and Salelologa.
• Children selling goods in public is strictly prohibited.

• Schools:
• Schools open on Monday 4 May 2020, until further notice.
• The Ministry of Education, Sports and Culture:
• is to design and determine appropriate programs and schedules i.e. which classes to attend school on which days of the week, what programs to undertake under the modes of teaching available to MESC at the time, for all schools (church, government, private) and so on; and
• is to, as much as possible administer the 2 meter social distancing rules. The schedules and programs under (a) are targetted to assist the Ministry’s attempts to maintain this rule.
• Where possible, parents and guardians are encouraged to use private vehicles for the drop off and pick up of children, to discourage crowdedness at schools, bus stops and other public places.  
• There shall be no crowding in public places such as bus stops and markets by students.

• Access to Health Facilities:
• All persons of the age of 60 and above are encouraged to remain at home and not move out and about in public, unless he or she is seeking medical attention at any health facility.
• All persons are prohibited from accessing any health facility unless he or she is seeking medical attention at any health facility.
• A person that is admitted to the hospital may:
  • only have one carer to tend to him or her; and
  • only be visited by 2 people at any one time.
• All patient care intended for travel overseas under the Samoa Medical Treatment Scheme are hereby suspended until further notice.

• Restriction for Government services:
• The Public Service Commission (“Commission”) is to determine conditions in which employees are to continue working under, with the objective of ensuring minimal spread of infection.
• The Commission’s conditions shall apply to all Government Ministries and Public Bodies.
• All Government trips overseas are hereby suspended until further notice.

1. Ministry of Health duties:

The Ministry of Health shall ensure to implement awareness programmes for the prevention of the spread the Covid-19.

1. Samoa Police Service:

The Samoa Police Service shall implement this Order.

1. Special Powers of Government Chief Executive Officers:
2. All Chief Executive Officers of Government Ministries and Public Bodies are empowered to exercise their statutory functions, duties and powers provided under any legislation, or administrative functions for the implementation of the Sector Preparedness and Response Matrix Consolidated for Corona Virus Pandemic (“Response Matrix”).
3. Cabinet is empowered to make Regulations, Rules or Orders for the implementation of the public sector duties and responsibilities, for maintaining safety, for the best interests of and the welfare of the country.

1. Emergency Order Offence Notice:
2. A police officer may serve an Emergency Order Offence Notice on a person who has committed an offence to which this Emergency applies.
3. A Notice under this Order shall be in the form approved by the Commissioner of Police.
4. A person who has been served with a Notice may elect to pay the fine stated in the Notice within 24 hours of the issuance of the Notice.

1. Penalties:
2. A person commits an offence where the person does not comply with any of the above orders, attracting the following penalties:
3. a fine of:
4. for an individual, a fine of $200 for a first offence, and a fine of $500 for a continuous offence; or
5. for an organization or corporation or similar such legal entity, a fine of $5,000 for a first offence, a fine of $7,000 for a continuous offence; or
6. detainment by the Police not exceeding 3 months; or
7. both detainment and fines prescribed under paragraph (a).
8. The payment of a fine under this Order, shall avoid any further prosecution for the offence stipulated in the Notice issued under Order 13.
9. Where a person is convicted of an offence under these Orders, he or she shall be liable to a fine not exceeding $10,000.00 or imprisonment not exceeding 12 months, or both. 

1. Advisory Board – Article 108:

The Advisory Board appointed under Article 108 of the Constitution, shall not incur any liability for actions done in good faith under Article 108.

1. Flexibility of procedures:
2. Given the pandemic Covid19, procedures of Cabinet and Parliament, may be relaxed during the State of Emergency, so that decision making for the good of the country may continue.
3. For effective decision making for the country, the above Orders do not bar any urgent and essential meetings of Cabinet and Parliament to take place during the State of Emergency.

1. Financing:

The financing of the implementation of this Order shall be funded by the appropriate budget approved by the Government.

The Emergency Order 9 issued on 17 April 2020 is revoked.  

This Order commences on Sunday 3^rd April 2020.

新型コロナウイルスに伴う非常事態宣言の修正案

政府広報室：国家元首のトゥイマレアリイファノ・ヴァアレトア・スアラウヴィ二世殿下は今晩、非常事態宣言をさらに４週間延長する法案を署名しました。

国家元首は内閣との協議の下、FK (20) Special 22の下、憲法106条に従い、以下の条例を発令しました（修正を含む）。

修正済みの条例は以下の通り。

1. 国民全体の断食と祈り：

国家的にすべてのサモアの家庭において2020年3月22日から3月29日の期間、午前6時から正午までを断食と祈りの時間とする。

• 国際渡航、航空便と船舶：
• 政府から許可を受けた特別な場合を除き、すべてのサモアへの航空便による出入国を停止する。
• 留意点：
  • サモアへの渡航を計画している方は以下をご留意ください。
    • 帰国者または帰国するサモア国籍の留学生
    • 渡航文書の有効期限が切れた場合；
    • サモアの社会機能を維持する為に必要なサービスを提供する場合；また
    • その他サモアへの渡航を要する特別な状況
  • 以下の必要項目がすべての渡航者に適用される。
• サモアへの渡航3日前以内にCOVID-19の検査を受けること；また
• サモアへの渡航前に14日間の自己隔離期間を完了したこと；また

(iii) サモア到着後に14日間隔離されること。

• 以下の場合を除き、すべての船舶の入港は禁止とする：

(a) 貿易と石油；また

(b) 必要物資の運搬及び荷下ろし、燃料補給を目的とした漁船。

(4) (3)(b)に該当する漁船の場合は以下が適用される：

(a) 1日に停泊できる船舶は２隻までとする；また

(b) すべての医療及び検疫ガイドラインを遵守すること；

(c) 乗組員は船舶を下船しないこと；

(d) 船舶のスケジュールはサモア港湾局（SPA）、農林水産省 (MAF); サモア警察庁 (MOPPS) そしてサモア保健省 (MOH) に必ず提出すること；また

• 最後の港から出航した日程、及び海上で乗組員の交換から28日以内の場合はアピア埠頭に入港できないものとする：また
• 入港日の通達は農林水産省またはサモア港湾局に５日前に受領されなければならない；また
• 海上で乗組員は交換してはいけない。
• 保健省はすべての入国者にメディカルクリアランスを継続して提供する。

• 集会：
• 教会の場合は以下が適用される：
  • 礼拝は安息日（EFKSの場合は日曜日、SDAの場合は土曜日）に一つまでとする；また
  • ２メートルの社会的距離を保つこと；また
  • 教会の礼拝前後に礼拝堂付近で群衆が集まること、礼拝後の教会活動は行わないものとする；また
  • 教会の牧師は礼拝堂内で社会的距離が保たれることを推奨する。
• 5名以上の集会は以下の場合には禁止する：
• 葬式、誕生日、結婚式、同窓会；また
• 建物などの開会式。
• あらゆる娯楽を目的とした集会は禁止する。ビンゴとカジノを除く。
• スポーツの場合、コンタクトスポーツではない競技（ゴルフ、テニス、バレーボール）やジム運営は認める。ただし、ラグビーなどのコンタクトスポーツは認められないものとする。

(5) ビーチや河川などでの遊泳は認めるものとする。（日曜日を除く）

(6) すべてのナイトクラブ、バー、劇場など公に人々が集まる場所は休業しなければならない。

(7) ホテルのバーは通常営業できるものとする。

• レストランの運営：
  • 店内営業とテイクアウトは午前6時から午後10時まで；また
  • 店内で飲食する場合はレストラン責任者が2メートルの社会的距離ルールが保たれることを監視すること。
• 認められた渡航をする者を除き、すべての人が空港や埠頭で集まることを禁止する。
• 公共交通機関：

バス・フェリー

• バスの運行：
  • バスは通常営業を継続する；また
  • 日曜日にはバスの運行を休業する。

(2)   5名以下の客席を持つ公共交通機関を運営する事業者は運行を継続できるものとする。

フェリー

(3) ウポル島とサバイイ島間のフェリーは以下の条件で運行を継続する：

• 日曜日にはフェリーの運行を休業する；また
• フェリーは月曜日から土曜日まで通常のスケジュールで運行する；また
• 海運当局はフェリー運行中に2メートルの社会的距離が保たれることを監視すること。

(4) 60歳以上の人は条例8に基づく制限（移動は医師から治療を求めるための移動のみ）を厳しく遵守すること。

• 条例8以外の目的で移動する年金受給者は年金特典の交通費の免除が適用されないものとする。

• 市場、小売店、スーパー、及び事業について：
• 市場：
• サヴァロロ、フガレイ、サレロロガ、ヴァイテレ、タウフシとアフェガ、及びすべてのフリーマーケット、魚市場や一般的にアクセスできるすべてのマーケットは：

(i) 月曜日から土曜日、午前6時から午後6時までの営業を認めるものとする；また

(ii) 全ての市場でのいかなる人の宿泊を禁ずる；また

• 以下の市場は日曜日に休業しなければならない：
• サバラロ、フガレイ、サレロロガ、バイテレ、タウフシ、アフェガ；また
• サバラロ、バイガガ、ファシイト・ウタ、アフェガの魚市場、また路傍におけるいかなる魚介類の販売；また
• 一般市民のアクセスできる全ての市場。
• スーパーの場合：
• 月曜日から土曜日の営業時間は午前6時から午後6時；また
• 日曜日の営業時間は午後3時から7時までとする；また
• 上記の営業時間の規定は小店には適用しないものとする；また
• (2)(b)で指摘されたスーパーも含まないものとする。
• スーパー：飲料や食料、またその他の商品を店内で購入できる店。
• 小店：店内に入ることはできず、外側の窓から商品を購入できる店。

• 露店について：
• アピア、バイテレ、サレロロガ付近のいかなる道路沿いや暗渠での物品の販売を禁止する。
• 児童による公衆の場における物品の販売を固く禁止する。

• 学校：
• 以後変更が無い場合、学校は2020年5月4日月曜日から再開とする。
• サモア文部省：
• は全ての学校（教会、公立、私立）における適切なプログラムやスケジュールを策定し、決定する。例：どの曜日にどの授業を学校で受けるか、どの方法で教育を行うか；また
• 2メートルの社会的距離が保たれることを管理すること。文部省により策定されるプログラムは社会的距離が保たれることを目的とする。
• 学校、また送迎バスやバス停などの公衆の場の混雑化を避けるため、可能な限り、児童の両親及び保護者は児童の送迎の為に、自家用車を利用すること。 
• 生徒などによる公衆の場などの押し合いを禁止する。

• 医療機関へのアクセス：
• 60歳以上の全ての人は医療機関にて診察を必要とする場合以外は自宅待機を続け、公衆の場への移動を避けること。
• 全ての人は医療機関にて診察を必要とする場合以外は医療機関を訪問しないものとする。
• 病院で入院している場合：
  • 介護者は一人1名までとする。
  • 一度の訪問者はあらゆる場合において2名までとする。
• サモアの医療計画の下で海外渡航を予定していたすべての患者の渡航計画を以後通知があるまで一旦中止する。

• 政府機関の制限：
• 公共事業委員会（委員会）は感染拡大を阻止する為に従業員の労働環境を管理する。
• 委員会の判断はすべての政府省庁と公的機関にも適用される。
• すべての政府機関の海外渡航は以後通知があるまで停止する。

1. 保健省の役割：

保健省はCOVID-19の感染拡大防止及びアウェアネス向上を目的としたプログラムを実装する。

1. サモア警察庁:

サモアの警察庁はこれらの命令を実装する。

1. 政府省庁の最高責任者の特別権限：
2. 政府機関及び公的機関のすべての最高責任者はコロナウイルスのパンデミックに対する対処マトリックスに基づき、法定機能や権限を発揮する。
3. 内閣は公共期間の責任実行、安全保障、また国家の繁栄と最善の為に法律や規則を策定できる。

1. 非常事態宣言違反の通知について：
2. 本命令への違反と該当する場合、警察官は非常事態宣言違反を通知することができる。
3. このように違反を通知する場合は警察庁の承認する書類に記入しなければならない。
4. 通知を渡された人は通知の発酵から24時間以内に罰則金を払うことができる。

1. 罰則について
2. これらの命令に従わなかった場合、以下のペナルティーが課せられる。
3. 罰金：
4. 個人が従わなかった場合、初回の違反は200ドル、2回目以降は500ドル、また
5. 企業や団体などの法的実体の場合、初回の違反は5000ドル、2回目以降は7000ドルの罰金が科せられる。または
6. 警察に３ヶ月未満の懲役が科せられる。または
7. 拘留と罰金、両方が科せられる。
8. 命令の違反に関する罰金の支払いを完了した者は命令13に従った追加の処罰を免れることができる。
9. これらの命令に従わなかった場合、10000ドル未満の罰金、又は１２か月以内の懲役、若くはその両方が科せられる。
10. 諮問委員会ー108条：

憲法108条により任命された諮問委員会は　誠意を持って行われた決断に関して責任を負わないものとする。

1. 手続きの順応性：
2. COVID-19のパンデミック発生により、内閣と議会の審議は国家の最善を記した最善を期した決断を続けることができるよう、緩和することができる。
3. 国家の為に最善の決断が継続される為、上記の命令は非常事態宣言下の内閣及び議会の緊急な会議を妨がないものとする。
4. 予算:

この緊急命令の必要経費は政府に認可された予算から算出される。

2020年4月17日に発令された非常事態宣言9は無効とする。

本項は2020年4月3日日曜日より有効とする。
